By purchasing any product or service from Vitality Precision Health, LLC (“VPH”, “we”, “our”, or “us”), you (“you”, “your”, “client”) agree to these Terms & Conditions. If you do not agree, do not proceed with purchase.

2. What We Offer

Vitality Report™

A personalized wellness report based on:

Your symptom intake (including date of birth)

Lab results via Evexia Diagnostics

Genetic summaries via SelfDecode

Coaching Services: Optional 3- or 6-month support packages for habit change, goal achievement, and lifestyle integration.

Our services are educational only and do not replace licensed medical care.

3. Not Medical Advice

VPH is not a medical provider.

We do not diagnose, treat, or prescribe.

Always consult your doctor before making health decisions.

4. What Data We Use

We Collect:

Your date of birth and symptom information (via secure FGFunnels forms)

Lab results from Evexia (with your permission)

Genetic summaries from SelfDecode (with your permission)

AI Processing:

We may use data to generate your Vitality Report via our HIPAA-enabled Azure OpenAI environment (under Business Associate Agreement).

Raw identifiable files are never uploaded.

Account Creation & Data Custody For WGS option

If you opt in to the WGS upgrade, your Sequencing.com account will be created and maintained under our master account for the purpose of ordering, processing, and delivering your genome data.

This setup means Vitality Precision Health will have full account-level access to your genomic data, including the ability to download, store, and process your raw data files.

Data Use

Your genomic data will be used solely for the purpose of providing the agreed-upon health coaching and analysis services. We will not share your raw data with any third party without your explicit written consent, except as required by law.

Data Storage & Security

Your data will be stored securely on Sequencing.com’s servers and within our private encrypted storage systems. Sequencing.com’s privacy and security policies also apply to your data; you may request a copy of these policies at any time.

Data Access, Transfer, and Deletion

You may request a copy of your raw genomic data at any time. You may request that we delete your genomic data from our systems and/or Sequencing.com, or transfer your data to a separate account in your name. Upon such a request, we will act promptly, subject to any legal or regulatory requirements for retention.

Acknowledgment of Different Processing Method

You understand that the Sequencing.com account setup differs from our standard DNA processing service, and that Vitality Precision Health will serve as the account holder with Sequencing.com on your behalf.

You consent to this arrangement for the purposes of your WGS Upgrade.

5. Privacy & Security

We are not a HIPAA-covered entity, but we follow HIPAA-equivalent safeguards.

We are compliant with the FTC Health Breach Notification Rule and relevant state consumer-health laws.

Your data is never sold or shared for marketing.

HIPAA-enabled Azure AI instance

Evexia Diagnostics

Selfdecode

Sequencing.com

6. Your Responsibilities

Provide accurate information

Stay under the care of a licensed healthcare provider

Take full responsibility for how you use our recommendations

7. No Guarantees

Your results may vary. We do not guarantee specific outcomes. Success depends on your genetics, lifestyle, and choices.

8. Payment & Refunds

Full payment is required unless a plan is offered.

Refund Policy:

100% refund (minus 5% fee) within 24 hrs if no work has started

No refund after data analysis begins

Pro-rated refunds for coaching at our discretion (in case of emergencies)

Unauthorized chargebacks may be sent to collections.

9. Scheduling

Coaching calls require 24-hour notice to reschedule. Missed sessions without notice are forfeited.

10. Ownership & Licensing

All content is intellectual property of VPH.

You receive a non-transferable personal-use license only.

11. Limitation of Liability

You agree not to hold VPH or its team liable for any damages except those arising from gross negligence or willful misconduct.

Our total liability shall never exceed the amount you paid.

12. Legal Stuff

Governed by the laws of Florida, USA

Any disputes will be handled in Manatee County, FL

Mediation is required before court action

These Terms may change. The current version is always posted with an updated effective date. Continued use = acceptance.
